What PCD monopoly rights mean in Indian pharma franchising, how territories are allotted, and what both sides should agree in writing.
PCD monopoly rights give one franchise partner the exclusive right to market and distribute a pharma company's products in a defined territory, usually a district. No other partner is appointed there for the same range while the agreement runs.
PCD stands for propaganda-cum-distribution. A pharma company appoints franchise partners who promote and sell its branded range in a territory. The company manufactures and supplies; the partner builds the market.
It does not mean a market monopoly in the legal sense. It is a contractual promise: in your district, for this product range, we will not appoint anyone else. Partners value it because their promotion effort cannot be undercut by another franchisee of the same company.
This is general information, not legal advice. Take advice before signing.
For the company, monopoly enquiries are among the highest-intent leads: a caller asks whether a district is still available. They need a fast answer and a clean record of which districts are taken. A CRM built for pharma tracks the territory, the molecules discussed and the follow-up in one place. See the PCD Pharma Franchise solution and the glossary.
